1. About these terms

These terms are an agreement between you and The Crafted Code Ltd, a company registered in England and Wales (company number 14639993), with its registered office address on Companies House ("we" or "us"), for the MindVape app, its widgets, Live Activity and shortcuts, and the mindvape.app website. Your licence to use the app comes from Apple's Licensed Application End User License Agreement (the "Apple EULA"). These terms add to it. If the two conflict, these terms apply, as far as the law allows. Our privacy policy explains how we handle data.

By downloading or using MindVape, you agree to these terms. If you don't agree, please don't use it.

2. Who can use MindVape

• You must be 18 or over (21 or over in the US), and over the legal age for buying and using vapes where you live.
• MindVape is for people who already vape. If you don't vape, please don't start.
• You may only use MindVape where it's legal to do so. It isn't offered in some countries.

The app asks Apple for your age range when you first open it, and stops if Apple says you're under the age limit.

3. What MindVape is, and isn't

• An awareness tool. MindVape helps you notice how you vape, so you can decide what comes next. It isn't a medical device, and it doesn't diagnose, treat, cure or prevent any condition.
• Not medical advice. Nothing in MindVape tells you whether vaping, or any amount of it, is safe for you. It's no substitute for advice from a doctor, pharmacist or stop-smoking service. If you're worried about your health, talk to one. In an emergency, call your local emergency number.
• Not a quit programme. MindVape doesn't set targets or promise results. If you want help to stop, Settings › Thinking about stopping? lists free support.
• Nicotine figures are estimates. MindVape shows only the nicotine in the liquid, worked out from what you enter. It's exact only when you enter the liquid used, and otherwise an "about" range from your puffs. It isn't a measure of what your body took in, and it depends on your entries being right.
• Patterns aren't causes. A pattern shows what lines up with your vaping in your own logs. It doesn't mean one thing causes another.
• Heads-ups are your own number. A Heads-up is a notification at a number you pick. It's a reminder, not a limit, and the app doesn't stop you or change anything when you reach it.
• Not a shop. MindVape doesn't sell or recommend vapes, liquids or flavours, and isn't connected to any vape brand. Names you type for your vapes are your own labels.

4. Your history and backups

Your history is stored only on your iPhone and, on purpose, isn't included in iCloud or iPhone backups. We don't have a copy, so we can't restore it for you. If you lose, replace or reset your iPhone, or delete the app, your history is gone unless you saved a backup file or moved it with "Move to a new iPhone".

Backup files are locked with a password you choose. We can't see, reset or recover it. Keeping your backup file and password safe is up to you.

5. MindVape Plus and tips

What Plus is

MindVape Plus is optional and adds extra views and features, such as patterns, month-by-month comparisons, Sleep and steps, the Summary for a GP, and more themes, icons and pod moods. The current list is in the app. Plus unlocks views, never your data. If Plus ends, everything you logged stays and you keep logging. Logging, your data, export, delete, privacy lock, Heads-ups and help to stop are never part of Plus.

Plans and prices

Prices in other countries are set in local currency, may include local taxes, and are shown in the app and the App Store before you buy. That price is the one that applies.

Subscriptions

• Payment is charged to your Apple Account when you confirm the purchase.
• Your subscription renews automatically for the same length and at the then-current price, unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
• You can manage or cancel your subscription in iPhone Settings › your name › Subscriptions, or at apps.apple.com/account/subscriptions. Deleting the app doesn't cancel it. When you cancel, Plus stays on until the end of the period you've paid for.
• If we change the price of a subscription, Apple tells you first and, where required, asks you to agree before the new price applies. If you don't agree, the subscription ends at the end of the current period.

Free trial

• The yearly plan may start with a 7-day free trial. Apple decides who's eligible, usually one trial per Apple Account.
• If you don't cancel at least 24 hours before the trial ends, it turns into a paid yearly subscription and you're charged. MindVape sends you a reminder 2 days before the trial ends, if notifications are on.
• If you buy another Plus plan during a trial, the rest of the trial ends.

Lifetime

Lifetime is a one-time purchase that gives you Plus for as long as we offer MindVape and Plus, on the Apple Account you used. It doesn't renew. The founding price is a launch offer for the first 90 days after MindVape is first released. The price then rises to the standard price, and people who bought at the founding price keep Plus.

Tips

Tips are one-time payments that support MindVape. They don't unlock anything, and they aren't donations to a charity.

Restoring, Family Sharing and refunds

• Plus is tied to your Apple Account, not to a MindVape account (there isn't one). On a new iPhone, use Settings › MindVape Plus › Restore.
• If Family Sharing is offered for a Plus plan, the App Store shows it before you buy.
• Apple handles payments and refunds. To ask for a refund, go to reportaproblem.apple.com. Where your local law gives you a right to cancel a digital purchase, Apple handles that too.

6. Using MindVape fairly

Please don't:

• copy, modify, resell or redistribute the app, or try to get its source code, except where the law allows;
• get around Plus, the age check or any security feature;
• interfere with the app, our services or other people's use of them;
• use MindVape to break the law, or in a way that would harm someone.

7. What's yours and what's ours

Yours: everything you enter, including notes and photos, stays yours. It lives on your iPhone, so we don't need, and don't take, any rights to it. If you add photos, make sure you have the right to use them. When you share a card, an export or a summary, you decide who sees it.

Ours: MindVape, including its name, logo, pod characters, design, text and code, belongs to us or our licensors and is protected by law. You may use it only as these terms and the Apple EULA allow.

Ideas: if you send us feedback or ideas, we may use them freely, without owing you anything.

8. Other companies' services

MindVape relies on Apple (the App Store, payments, Apple Health, Siri, widgets and the age range), Google (Firebase) and RevenueCat. Their services are covered by their own terms, and we're not responsible for how they work. Using Apple Health in MindVape is optional.

9. Changes, and if MindVape ends

• We may update MindVape, add or remove features, or stop offering it in some countries. We won't take away a feature you've paid for without good reason, such as a legal or security problem, or a change by Apple.
• We may change these terms. If a change matters, we'll tell you in the app before it applies. If you keep using MindVape after that, the new terms apply. If you don't agree, you can stop using MindVape and cancel any subscription.
• If we ever stop MindVape, we'll try to give at least 30 days' notice in the app. Your history is on your iPhone, so you'll still be able to export it.
• You can stop using MindVape at any time by deleting it. Remember to cancel any subscription in your Apple Account settings.

10. Our responsibility to you

We work hard to make MindVape accurate and reliable, but it depends on what you enter, on your iPhone and on Apple's services. Apart from what these terms promise and what the law requires, we provide MindVape "as is" and "as available", and we don't promise it will always be error-free, uninterrupted or right for your needs.

As far as the law allows, we're not responsible for:

• decisions you make based on MindVape, including about your health;
• history you lose because you didn't keep a backup file, or forgot its password;
• losses we couldn't reasonably have foreseen, or business losses;
• things outside our reasonable control.

As far as the law allows, our total responsibility to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and US$50 (or the same amount in your currency).

Nothing in these terms limits responsibility that the law doesn't allow us to limit. That includes our responsibility for death or personal injury caused by our negligence, for fraud, and, if you're a consumer in the UK or EU, your statutory rights, including your right to a digital service that is as described, of satisfactory quality and fit for purpose. Some US states don't allow certain exclusions, so some of the above may not apply to you.

11. Apple

Because you get MindVape from the App Store, you and we both agree that:

• these terms are between you and us, not Apple, and we, not Apple, are responsible for MindVape and its content;
• Apple has no obligation to provide maintenance or support for MindVape;
• if MindVape fails to meet a warranty that applies, you can tell Apple, and Apple will refund the price you paid for the app (if any). Apple has no other warranty obligation for MindVape, as far as the law allows;
• Apple isn't responsible for any claims about MindVape, including product liability claims, claims that it doesn't meet legal or regulatory requirements, and consumer protection, privacy or similar claims. We are;
• if anyone claims that MindVape infringes their intellectual property, we, not Apple, are responsible for dealing with it;
• you confirm that you're not in a country subject to a US government embargo or designated as "terrorist supporting", and you're not on a US government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales can hear disputes. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. If you're a consumer anywhere else, you also keep the protection of the mandatory laws of the country or state where you live, and you can bring a claim in your local courts. Before going to court, please email us. Most problems can be sorted out quickly.

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You can't transfer these terms to someone else. We may transfer them to a company that takes over MindVape, and your rights under them won't be reduced.
